Copyright and takedowns
If something on dubem uses your work without permission, tell us and we will act on it.
What this covers
dubem sells digital collectibles: some from our own series, most from collections made by others, each one held in our vault before it is listed. The artwork, names and descriptions you see come from those collections. If you own the rights to a work and believe a collection or a single item on dubem copies it, or uses your trade mark, without your permission, this page explains how to tell us.
How to report
Email dmca@dubem.io, or write to Jubbly Online Limited, Attn: Copyright, 51 Lavenham Road, Grimsby, DN33 3HJ, United Kingdom. Please include:
- Your name, postal address, email address and phone number.
- The work you say is being infringed, for example a link to the original, or a description if it is not online.
- Where it is on dubem: the link to each item page, or to the collection if it is the whole collection.
- Whether you are the rights holder or are acting for them, and if so for whom.
- A statement that you believe in good faith that this use is not authorised by the rights holder, its agent or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the rights holder or authorised to act for them.
- Your signature. Typing your full name at the end of the email is enough.
A notice that follows the US Digital Millennium Copyright Act (DMCA) has these parts already, and we accept it in that form.
What we do
- We confirm we have your notice, and ask for anything missing.
- If the notice is complete and the claim is credible, we take the item, or the whole collection, off sale on dubem while we look into it.
- We tell you what we did. If we decide not to act, we tell you why.
Some things are outside what anyone can do. A blockchain record cannot be changed or deleted, so we cannot remove a token from the blockchain itself, and a collectible already sold belongs to its buyer and stays in their vault. What we control is whether dubem offers and shows it, and that is what we change.
If you think we removed something by mistake
If an item was taken off sale and you believe that was a mistake, for example because you created the collection or hold a licence for it, send a counter-notice to dmca@dubem.io with:
- Your name, postal address, email address and phone number.
- The item or collection that was removed, and where it was listed.
- A statement, under penalty of perjury, that you believe in good faith it was removed by mistake or because it was misidentified.
- Your consent to the jurisdiction of the courts where you live (or, if you live outside the US and the claim was made under the DMCA, any US federal court where we can be found), and that you will accept service of proceedings from the person who made the claim.
- Your signature. Typing your full name is enough.
We send the counter-notice to the person who made the claim. If they do not tell us within 14 days that they have started legal proceedings, we may put the item back on sale.
Repeat problems
A collection that is the subject of repeated valid claims is removed from dubem for good.
False claims
Please only send a notice if you are confident in it. Knowingly misrepresenting that something infringes, or that it was removed by mistake, can make you liable for the costs and damages it causes.
